Data Processing Agreement

This Data Processing Agreement ("DPA") forms part of the Terms of Service between you ("Operator") and Mailmate, Ltd. ("Processor").

1. Scope

This DPA applies where mailmate processes personal data on behalf of the Operator in connection with transactional email relay services.

2. Processing Details

• Nature of processing: Storage and transmission of transactional email message metadata
• Purpose: Delivery of transactional email as instructed by the Operator
• Duration: For the term of the agreement
• Types of personal data: Email addresses, message identifiers, delivery timestamps
• Categories of data subjects: End-users of the Operator's clients (tenants)

3. Processor Obligations

Mailmate will:

• Process personal data only on documented instructions from the Operator
• Ensure personnel are bound by confidentiality
• Implement appropriate technical and organisational security measures
• Assist the Operator with data subject rights requests
• Delete or return data at the end of the service relationship
• Provide information necessary to demonstrate compliance

4. Sub-processors

See our Privacy Policy for the current list of sub-processors. We will provide 30 days' notice of any changes.

5. International Transfers

Where personal data is transferred outside the EEA, we rely on Standard Contractual Clauses as the transfer mechanism.
